1Who we are and what this policy covers

This Privacy Policy explains how Buildberg Pty Ltd (we, us or our) collects, uses, holds and discloses your personal information when you use say-vi, our artificial intelligence avatar and video platform, together with our websites, applications, application programming interfaces and related services (the Services).

We are committed to protecting your privacy and to handling personal information in accordance with the Privacy Act 1988 (Cth) (the Privacy Act) and the Australian Privacy Principles (the APPs). By using the Services you agree to the collection, use and disclosure of your information as described in this policy.

2The personal information we collect

The kinds of personal information we collect depend on how you use the Services. They include:

Information you provide to us

  • Account details, such as your name, email address and password.
  • Images and likeness, including the photos and portraits you upload to create an avatar. Facial images and the avatars derived from them may be sensitive information (see section 3).
  • Creative inputs and outputs, including the briefs, prompts, scripts, captions, avatars and videos you enter, generate or edit.
  • Connection authorisations, including the access tokens and limited account information you provide when you connect a social platform so that we can publish on your behalf.
  • Developer credentials, including the API keys you create to access the Services programmatically.
  • Support and communications, including the content of messages you send us.
  • Billing details, if and when you purchase paid features. Payment card data is handled by our payment provider, not stored by us.

Information we collect automatically

  • Device and connection data, such as IP address, browser type, device and operating system.
  • Usage and log data, such as the pages you view, actions you take, render jobs you start, and timestamps.
  • Cookies and similar technologies, including the signed session cookie used to keep you signed in.

Information from third parties

  • Connected platforms, which may return limited account information needed to publish content you have authorised.
  • Service providers that help us operate, secure and improve the Services.

3Sensitive information, likeness and biometric data

Facial images, and the avatars and voice or video likenesses created from them, may constitute sensitive information under the Privacy Act. We collect and use this information only with your consent and only to provide the Services to you, such as to create and operate your avatar, render videos and let you publish them.

Before you upload an image, you must confirm that you are the person depicted, or that you have the express, informed consent of every identifiable person in the image. The Services require you to confirm this consent before an avatar is created, and that requirement cannot be skipped.

You may withdraw your consent at any time by deleting the relevant avatar or content, or by contacting us. Withdrawing consent does not affect processing already carried out before the withdrawal.

4How we use your information

We use personal information to:

  • create your account and authenticate you;
  • generate avatars, draft scripts and render videos at your request;
  • publish content to the platforms you choose to connect;
  • provide customer support and respond to your enquiries;
  • operate, secure, maintain, analyse and improve the Services;
  • detect, prevent and respond to fraud, abuse and security incidents;
  • comply with our legal obligations and enforce our terms; and
  • where you have consented, send you product updates and marketing.

5How we disclose your information

We do not sell your personal information. We disclose personal information to the following categories of recipients so that we can provide the Services:

  • Technology providers that power core features, including HeyGen (avatar creation and video rendering) and OpenAI (script generation).
  • Social platforms you choose to publish to, including Meta (Instagram and Facebook) and TikTok.
  • Cloud hosting, storage, analytics and security providers that operate our infrastructure.
  • Professional advisers, such as our lawyers, accountants and auditors.
  • Law enforcement, regulators or other parties where required or authorised by law.
  • A buyer or successor, in connection with a sale, merger or restructure of our business.

These third parties handle your information under their own terms and privacy policies. We encourage you to review them.

6Overseas disclosure

Some of our service providers, including HeyGen, OpenAI and certain hosting and platform providers, are located in or store data outside Australia, primarily in the United States. By using the Services, you acknowledge and consent to your information being disclosed to recipients in those countries, which may not have laws substantially similar to the APPs. We take reasonable steps to ensure that overseas recipients handle your information consistently with this policy.

7Cookies and similar technologies

We use cookies and similar technologies to keep you signed in, remember your preferences and understand how the Services are used. You can control cookies through your browser settings, although some features may not work correctly without them.

8How we keep your information secure

We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure. These steps include signed session tokens, hashing of passwords and encryption of data in transit. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.

9How long we keep your information

We retain personal information only for as long as necessary to provide the Services and to meet our legal, accounting and reporting obligations. When information is no longer required, we take reasonable steps to delete or de-identify it. You may ask us to delete your account and associated content, including avatars and videos, as described in section 10.

10Accessing and correcting your information

You may request access to, or correction of, the personal information we hold about you. You may also ask us to delete your information, withdraw your consent, or opt out of marketing at any time. To make a request, contact us using the details in section 14.

We will respond within a reasonable period and may need to verify your identity first. In the limited circumstances permitted by law where we decline a request, we will tell you why.

11Direct marketing

If we send you marketing communications, you can opt out at any time using the unsubscribe function in the message or by contacting us. We do not use sensitive information for direct marketing.

12Notifiable data breaches

If we become aware of a data breach that is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner (the OAIC) in accordance with the Notifiable Data Breaches scheme.

13Third-party platforms and links

The Services let you connect to and publish on third-party platforms and may contain links to third-party websites. We are not responsible for the privacy practices or content of those third parties, and we encourage you to review their policies before using them.

14Children

The Services are not directed to individuals under 18, and we do not knowingly collect personal information from a person under 18. You must not upload an image of a minor unless you are their parent or guardian, or you otherwise have appropriate authority and consent.

15Changes to this policy

We may update this policy from time to time. We will post the updated version with a new effective date, and where changes are significant we will take reasonable steps to notify you.
